These Terms of Service apply to consumer purchases made through the MOR Padel website at www.morpadel.co.uk and to your use of our online store.

The website and MOR Padel brand are operated by MOR PADEL LTD, a private company limited by shares registered in England and Wales under company number 17106243.

These terms are intended for normal retail purchases by consumers. Separate terms may apply to business, wholesale, teamwear, personalised or other bespoke orders agreed directly with MOR Padel.

1. Placing an order

When you place an order through our website, you are offering to purchase the products in your order in accordance with these terms.

After placing your order, you should receive an email confirming that we have received it. This acknowledgement does not mean that we have accepted your order.

We accept your order when we send you confirmation that the relevant products have been dispatched. At that point, a contract is formed between you and MOR PADEL LTD for those products.

If an order contains products dispatched separately, a separate contract may be formed for each product when its dispatch is confirmed.

Payment may be authorised or taken before we dispatch your order. Taking payment does not by itself mean that we have accepted the order. If we cannot accept an order after taking payment, we will refund the relevant amount.

2. When we may not accept an order

We may be unable to accept an order if, for example:

  • the product is unavailable
  • we cannot obtain authorisation for your payment
  • the delivery address is outside an area we currently serve
  • there is an obvious and unmistakeable error in the price or product information which could reasonably have been recognised as an error
  • we reasonably suspect fraud or unlawful activity
  • we are unable to supply the product for a legal or operational reason

If we cannot accept your order, we will let you know and refund any amount already paid for products we will not supply.

3. Products

We take reasonable care to ensure that product descriptions, images, colours, sizes and other information on our website are accurate.

Colours and appearance can vary slightly depending on your screen, lighting and the nature of the materials used.

Measurements and sizing information are provided to help you choose the right product. Please review any available sizing information before ordering.

Nothing in these terms affects your statutory rights. Products supplied by MOR Padel must be of satisfactory quality, fit for purpose and as described.

4. Prices and payment

Prices are shown in pounds sterling (GBP).

The price shown for a product is the price payable for that product unless there is an obvious pricing error.

MOR PADEL LTD is not currently registered for VAT and does not currently charge VAT on its sales.

Delivery charges are shown separately before you complete your order.

We accept the payment methods displayed during checkout. Payments are processed securely through Shopify and its payment providers.

Prices and promotions may change from time to time, but a later change will not alter the price of an order that we have already accepted.

5. Delivery

We currently deliver within the United Kingdom only.

Current delivery charges, dispatch expectations and delivery information are set out in our Shipping policy and are also displayed during checkout.

We currently aim to dispatch standard orders within 2 working days.

Unless a different delivery period has been agreed with you, we will deliver your goods without undue delay and no later than 30 days after the contract is entered into.

Delivery estimates are not guarantees where delays arise from circumstances outside our reasonable control, but this does not affect any rights you may have where delivery is late.

Please provide a complete and accurate delivery address. If you notice an error after ordering, contact hello@morpadel.co.uk as soon as possible. We will try to help, but we cannot guarantee that an address can be changed once fulfilment has begun.

6. Risk

The products become your responsibility when they are delivered to you or to another person you have identified to receive them on your behalf, other than the delivery carrier.

This does not affect your rights if a parcel is lost or damaged before it reaches you.

7. Your right to change your mind

If you are purchasing as a consumer online, you normally have the legal right to cancel your purchase without giving a reason.

For an order delivered in one delivery, the cancellation period ends 14 days after the day on which you, or someone you nominate other than the carrier, receives the goods.

If you order multiple goods in one order and they are delivered on different days, the cancellation period normally ends 14 days after the day on which the last of those goods is received.

To exercise your right to cancel, you must clearly tell us that you have decided to cancel before the cancellation period expires.

You can do this by emailing hello@morpadel.co.uk. You may also use the model cancellation form at the end of these terms, although you do not have to use it.

After telling us that you are cancelling, you must send the goods back without undue delay and no later than 14 days after telling us.

8. Return postage for change-of-mind returns

For an ordinary change-of-mind return, you are responsible for the direct cost of returning the goods to us unless we agree otherwise.

Please contact hello@morpadel.co.uk before sending anything back so that we can provide the correct return instructions.

We recommend using a postal service that provides appropriate tracking or proof of postage.

This section does not apply in the same way where goods are faulty, damaged, incorrect or otherwise fail to meet your statutory rights.

9. Handling returned goods

You may inspect and handle a product to the extent reasonably necessary to establish its nature, characteristics and functioning, in broadly the same way that you could inspect it in a shop.

If the value of a product has been reduced because it has been handled beyond what is reasonably necessary, we may make an appropriate deduction from the refund where the law allows us to do so.

10. Refunds following a change of mind

Where you validly cancel a qualifying whole order, we will refund:

  • the price paid for the returned goods; and
  • the amount you paid for our standard delivery service

If you chose a more expensive delivery service than our standard option, we do not have to refund the additional cost above the standard delivery charge.

If you return only part of an order, the original outbound delivery charge will not normally be refunded where you would have paid the same delivery charge for the products you keep.

Refunds will be made without undue delay and, where we have not offered to collect the goods, no later than 14 days after the earlier of:

  • the day we receive the returned goods; or
  • the day you provide evidence that you have sent the goods back

We will normally refund you using the same payment method you used for the original transaction unless you expressly agree otherwise.

We will not charge you a fee for issuing a statutory refund.

Your bank or payment provider may take additional time to show the refunded amount in your account after we have processed it.

11. Faulty, damaged or incorrect products

Your legal rights relating to faulty, damaged, misdescribed or otherwise non-conforming goods are separate from your right to change your mind.

If a product is faulty, damaged, not as described or does not otherwise meet your statutory rights, contact hello@morpadel.co.uk with your order number and details of the problem. Photographs may be useful where the issue can reasonably be shown in an image.

Depending on the circumstances and your legal rights, you may be entitled to a refund, repair or replacement.

Where goods are faulty, damaged or supplied incorrectly and a return is reasonably required, MOR Padel will cover the appropriate return costs.

Nothing in these terms limits your statutory rights under consumer law.

12. Cancelling or changing an order before dispatch

If you want to cancel or change an order before it has been dispatched, contact hello@morpadel.co.uk as soon as possible.

We will do our best to help, but fulfilment may already have begun and we cannot guarantee that an order can be amended before dispatch.

This does not affect your statutory right to cancel a qualifying distance-sale purchase.

13. Exchanges

We do not currently offer direct exchanges as part of our standard online returns process.

If you would like a different size, colour or product, you can return the original qualifying item in accordance with our Return and refund policy and place a new order.

14. Promotions and discount codes

From time to time we may offer promotional prices or discount codes.

Any additional terms that apply to a particular promotion will be stated with that promotion.

Unless otherwise stated, promotional codes cannot be exchanged for cash and must be applied during checkout. A promotion does not affect orders placed before it began or after it ended.

We reserve the right to withdraw or correct a promotion where there has been an obvious error or misuse, provided that doing so does not unfairly affect a contract we have already accepted.

15. Website use

You may use the MOR Padel website for lawful personal use.

You must not knowingly:

  • use the website for fraudulent or unlawful purposes
  • interfere with the operation or security of the website
  • attempt to gain unauthorised access to our systems
  • introduce malicious software or code
  • reproduce or commercially exploit protected MOR Padel material without permission

We may temporarily suspend or restrict parts of the website where reasonably necessary for maintenance, security or technical reasons.

16. Intellectual property

Unless otherwise stated, intellectual property in the MOR Padel name, branding, graphics, photographs, designs, written content and other original material on our website is owned by or licensed to MOR PADEL LTD.

You may access and use the website for your own personal, non-commercial purposes.

No ownership of MOR Padel intellectual property is transferred to you by your use of the website or purchase of a product.

17. Third-party services

Our online store is hosted by Shopify and uses third-party services for functions including payments, ecommerce infrastructure and delivery.

The presence of a third-party service or external website link does not mean that MOR Padel controls that third party.

However, nothing in this section removes any responsibility MOR Padel has to you under the contract for products you purchase directly from us.

Personal information is handled in accordance with our Privacy policy.

18. Our responsibility to you

If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of the contract or our failure to use reasonable care and skill.

Loss or damage is foreseeable if it was obvious that it would happen or if both you and we knew that it might happen when the contract was formed.

If you are purchasing as a consumer, we do not accept responsibility for losses relating purely to your trade, business, craft or profession.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for:

  • death or personal injury caused by negligence
  • fraud or fraudulent misrepresentation
  • breach of your statutory rights relating to goods
  • any other liability that cannot lawfully be excluded

19. Events outside our reasonable control

Sometimes our ability to fulfil an order may be affected by events outside our reasonable control.

If this happens, we will take reasonable steps to minimise the effect of the delay and, where appropriate, keep you informed.

This does not remove any statutory right you may have to cancel because of a significant delay or failure to deliver.

20. Changes to these terms

We may update these terms from time to time to reflect changes to our website, business, services or legal requirements.

The terms applying to a purchase are generally those in force when you place your order. We will not retrospectively change the terms of an existing contract to your disadvantage unless required by law.

The latest version will be published on our website with an updated date.

21. Complaints

If something has gone wrong, please contact hello@morpadel.co.uk and we will try to resolve the issue fairly.

We aim to respond to customer enquiries within 2 working days, Monday to Friday.

22. Governing law and courts

These terms and any contract between you and MOR PADEL LTD are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory rights and protections that apply to you where you live.

Nothing in these terms prevents you from bringing a claim in a court that has jurisdiction under applicable consumer law.
